Construction Regulation 8: Management and Supervision of Construction Work  

Definition "competent person" means a person who-

(a) has in respect of the work or task to be performed the required knowledge, training and experience and, where applicable, qualifications, specific to that work or task: Provided that where appropriate qualifications and training are registered in terms of the provisions of the National Qualification Framework Act, 2000 (Act No.67 of 2000), those qualifications and that training must be regarded as the required qualifications and training; and (b) is familiar with the Act and with the applicable regulations made under the Act;

Appointment of a Competent Construction Manager

Regulation 8(1) mandates that the principal contractor must appoint, in writing, a full-time competent construction manager responsible for managing all construction work on a single site. The construction manager must also ensure compliance with occupational health and safety standards on site. This appointment must be documented, and in the event the construction manager is unavailable, an alternate construction manager must be appointed to assume their duties.

Appointment of Competent Assistant Construction Managers

For larger or more complex projects, Regulation 8(2) requires the principal contractor to appoint one or more assistant construction managers for different sections of the project. These assistant construction managers support the overall supervision but do not relieve the construction manager of their personal accountability for health and safety responsibilities.

If an inspector finds that an insufficient number of assistant construction managers have been appointed, they may, under Regulation 8(3), issue a directive for the appointment of additional personnel. This ensures that there is adequate oversight across all areas of the project.

Construction Managers’ Focus on a Single Site

As stipulated in Regulation 8(4), the construction manager is assigned to a single site and may not oversee multiple sites. This requirement ensures that the construction manager can focus on the specific risks, challenges, and operations of one location at a time, reducing the likelihood of health and safety oversights.

Appointment of a Competent Construction Health and Safety Officer

In compliance with Regulation 8(5), the contractor must consider the size of the project, the degree of danger, and the accumulation of hazards when determining whether to appoint a construction health and safety officer. This individual, appointed either full-time or part-time, is responsible for controlling all health and safety-related aspects on site. If there is any doubt about whether a health and safety officer is necessary, the decision of an inspector will be final.

The construction health and safety officer must possess the required competencies and be registered with a statutory body approved by the Chief Inspector, in this case it will be SACPCMP, as outlined in Regulation 8(6). This ensures that the officer is qualified to manage health and safety requirements effectively.

Appointment of Competent Construction Supervisors

Under Regulation 8(7), the construction manager must appoint, in writing, construction supervisors responsible for day-to-day construction activities and ensuring compliance with occupational health and safety regulations. These supervisors play a critical role in maintaining site safety and managing specific areas of the construction work.

Competent  Assistant Construction Supervisors

To further support site management, Regulation 8(8) allows the contractor to appoint competent employees to assist the construction supervisor for different sections of the site. These employees are given the same responsibilities as the supervisor, but their designation does not relieve the supervisor of their accountability.

If an inspector determines that additional employees are required, they may issue a directive under Regulation 8(9), ensuring that the site is adequately supervised.

Site Supervision Restrictions

Finally, under Regulation 8(10), a construction supervisor may only oversee the specific site to which they are appointed. However, if sufficient competent employees are appointed to assist, a construction supervisor may supervise more than one site. This clause ensures that all construction sites are adequately monitored without overburdening any single supervisor.
