The fall protection plan must include the following but is not limited to:

  1. A risk assessment for all work done from a fall risk positions and procedures and methods used to address all risks identified per location
  2. The process for the evaluation of Medical fitness

Each one of these have their own set of legal requirements that is applicable not just for

construction sites but also all other areas where employees are exposed to fall risks:

  1. Fall Protection Risk Assessment for all work done from a fall risk position (CR 10(2)(a))

A fall protection risk assessment is conducted in which all your hazards and risk specific to working at heights are identified, analysed, and controlled. This should include the safe work procedures and methods.

  1. Process for evaluation of Medical Fitness when exposed to fall risks (CR 10(2)(b))

The employer needs to establish the medical ability of each employee working at heights. This is done through a registered occupational practitioner in the form of an Annexure 3 and is conducted on an annual basis.

  1. Program for Training for all work done from a fall risk position (CR 10(2)(c))

Due to different access methods which can be used for working at heights, it is important to understand the type of training required for each method used. All formal training must be done according to the relevant Unit Standard, (or an LNQ registered with the IWH where no unit standards exist), as well as a SETA accredited training provider or a training provider registered with the Institute for Work at Height Professional Body.

  1. Equipment Management (CR 10(2)(d))

When establishing the types of equipment to be used, equipment should be manufactured according to the relevant SANS /EN standards. The competency, capabilities, and types of training received should also be considered when inspection, testing and maintenance of equipment is included. Equipment should have certificate of conformances, records of previous inspections as well as a method for traceability.

  1. Rescue Plan (CR 10(2)(e))

The rescue plan must not be generic and written to cover the requirements as established in the risk assessment and the context of the fall protection plan. The rescue plan is easier aligned with the fall protection plan if it forms part of the fall protection plan and not established as an individual document. The rescue plan needs to include specific rescues, equipment to be used, competency required for the rescue as well as the procedure for the rescue/s, for all identified working at height methods. The employer also needs to ensure that the rescue plan can be implemented immediately after a fall arrest incident occurred.

It outlines specific procedures and methods to ensure the safety of drivers and other road users. Appointments & Competencies refer to the documented process of designating individuals to specific roles and verifying their qualifications to perform those roles effectively. Examples of such roles include site supervisors, safety officers, and first aid responders.

  • Health and Safety Officer: Construction Regulation 8(5)and(6) - In line with Construction Regulation 8(5) (Health and Safety Officer), a contractor must, after consultation with the client and considering the project's size, the degree of danger likely to be encountered, or the accumulation of hazards or risks on the site, appoint a full-time or part-time construction health and safety officer in writing. This officer assists in managing all health and safety-related aspects on the site. Should there be any uncertainty about the necessity of appointing a construction health and safety officer, the decision of an inspector will be decisive. Ensuring that appointed individuals possess the required competencies is crucial for effective health and safety management, minimizing risks, and maintaining compliance with regulatory requirements.

    Moreover, according to Construction Regulation 8(6), no contractor may appoint a construction health and safety officer to assist in the control of health and safety-related aspects on the site unless the contractor is reasonably satisfied that the officer is registered with a statutory body approved by the Chief Inspector, in this case, SACPCMP, and has the necessary competencies and resources to assist the contractor.
  • Project Manager: Occupational Health and Safety Act Section 16(2) - Oversees the overall management and coordination of a project. Section 16.2 allows the Chief Executive Officer may assign their duties to any person under their control, making it clear that the assigned person shall operate under the direction and control of the Chief Executive Officer
  • Construction Manager: Construction Regulation 8(1) - Manages the construction site, ensuring work is carried out safely and efficiently. A principal contractor must, in writing, appoint one full-time competent person as the construction manager responsible for managing all construction work on a single site. This includes ensuring occupational health and safety compliance. In the absence of the construction manager, an alternate must be appointed by the principal contractor.
  • Fall Protection Planner: Construction Regulation 10(1)(a) - A contractor must designate a competent person to be responsible for the preparation of a fall protection plan. This individual ensures that the fall protection plan is implemented, amended as necessary, and maintained as required. The contractor must also take steps to ensure continued adherence to the fall protection plan.
  • Incident Accident Investigator: General Administrative Regulation 9 - An employer or user must maintain a record of all reportable incidents as specified in section 24 of the Act, including any incident necessitating medical treatment beyond first aid, in the form of Annexure 1 for at least three years, available for inspection by an inspector. Every incident must be investigated within 7 days by the employer, an appointed person, a health and safety representative, or a member of a health and safety committee, and findings must be recorded in Annexure 1 immediately upon investigation completion. The health and safety committee must review these records at its next meeting to ensure that necessary preventative actions are implemented and followed up.
  • Health and Safety Representative: Occupational Health and Safety Act Section 17(1) - Every employer with more than 20 employees must nominate a health and safety representatives in writing for a specified period within four months of the Act's commencement, starting a business, or when the number of employees exceeds 20. These representatives are appointed for the workplace or different sections thereof, ensuring that health and safety measures are effectively implemented and maintained.
  • Risk Assessors: Construction Regulation 9(1) - Conducts assessments to identify and mitigate potential risks. A contractor must, before the commencement of any construction work and during such work, have risk assessments performed by a competent person appointed in writing. These risk assessments are part of the health and safety plan applied on the site and must include:
    • (a)Identification of the risks and hazards to which persons may be exposed.
    • (b) Analysis and evaluation of the identified risks and hazards based on a documented method.
    • (c) A documented plan and applicable safe work procedures to mitigate, reduce, or control the identified risks and hazards.
    • (d) A monitoring plan.
    • (e) A review plan.
    • First Aider: General Safety Regulation 3 - Provides immediate medical assistance in case of injuries or emergencies. According to General Safety Regulation 3(4), where more than 10 employees are employed at a workplace, the employer must ensure that for every group of up to 50 employees, at least one person is readily available during normal working hours who is certified in first aid. In the case of a shop or office as contemplated in the Basic Conditions of Employment Act, for every group of up to 100 employees, at least one certified first aider must be available.
